1. Acceptance of Terms

By accessing or using theinclusivepractice.com or any product operated by The Inclusive Practice, LLC, you agree to be bound by these Terms of Use. If you do not agree, please do not use our services.

2. Use of Services

Our platforms are intended for use by educational professionals and institutions. You agree to use our services only for lawful purposes and in ways that do not infringe the rights of others.

3. Intellectual Property

All content, frameworks, curriculum materials, and software on our platforms are the property of The Inclusive Practice, LLC and are protected by applicable intellectual property laws. The Trust Framework and PULSE platform are proprietary products of The Inclusive Practice, LLC.

4. Student Data and FERPA

Where a district or agency uses PULSE, access to student data is governed by a Data Access and Protection Agreement executed between The Inclusive Practice, LLC and that organization. Under that agreement, the organization designates the Company as a School Official with a legitimate educational interest under FERPA, 34 C.F.R. § 99.31(a)(1). The agreement defines the categories of data processed, the permitted and prohibited uses, security standards, subprocessors, breach notification obligations, and retention and return terms.

The Company does not sell student data, does not use it for targeted advertising, and does not build individual student profiles except as required to deliver the contracted services. Districts remain the owners of their data and remain responsible for responding to parent and student requests under FERPA and IDEA.

5. Limitation of Liability

Limitation of liability terms are set out in the agreement executed between the Company and each customer organization.

6. Governing Law

These terms are governed by the laws of the Commonwealth of Massachusetts.
